False Allegations In Colorado Springs Sex Assault Case

False Allegations In Colorado Springs Sex Assault Case

False allegations and charges of sexual assault are more common than in Colorado than one might think. This fact was proven once again in El Paso County District Court – Colorado Springs, Colorado,

The El Paso County District Attorney was required to dismiss sexual assault charges against Colorado Springs psychologist Dr. Janice Husted because of a lack of evidence.

Dr. Husted was cleared of all sex assault charges after she was accused of having a sexual relationship with a military veteran under her care. While the prosecutor refused to disclose the reasons for the dismissal – there is only one reason the DA would dismiss the case in this manner – what is that? – a thorough criminal defense investigation by the defense lawyer disclosed that the alleged victim had lied and hidden critical evidence to the state’s investigators.

The Importance Of A Thorough Criminal Defense Investigation

The defense investigation  – not the “look the other way” approach of most prosecutors – disclosed that the alleged “victim” (whose name, by the way, is never mentioned by the way in any of the media accounts) made the allegations to extort money from his treatment provider.

The truth is – any relationship – ifone occurred at all – was long after she was treating him as a patient and the money demands were pure extortion.

False Allegations In Colorado Springs Sex Assault Case – Email And Respond H. Michael’s Take

The importance of closely examining the facts and evidence that is alleged against the client is the most critical aspect of the thorough criminal defense.  At times the evidence may seem overwhelming and may even include incriminating statements by the accused him or herself.  This does not mean that an experienced Colorado criminal defense lawyer cannot locate facts and evidence to support the mitigation of the People’s evidence. In short – I have obtained many dismissals of charges and excellent plea bargains by looking deeper at the allegations and at the person making them.
