    A Colorado Criminal Lawyer On Crimes Of Prostitution – Adults – Colorado crimes addressing prostitution run the gamut from the least serious – to possible life sentences if children are in any way involved.

    What Follows Is A Summary of The Most Critical Of These Colorado Prostitution Laws

    The “Basic” Crime of Prostitution – 18-7-201

    The Crime of Prostitution Under Colorado Law Occurs Under C.R.S. § 18-7-201 is when a person:

    “performs, offers to perform, or agrees to perform any act of sexual intercourse, fellatio, cunnilingus, masturbation or anal intercourse with a person, not his or her spouse, in exchange for money or other thing of value.”

    At this level – the Colorado crime of prostitution is the lowest of all misdemeanors – a class 3 misdemeanor.

    A Prostitute With AIDS C.R.S. – 18-7-201.7.

    If a prostitute is aware that he or she has AIDs and then commits an act of prostitution knowing that he or she is infected with the acquired immune deficiency syndrome (AIDS) that person commits a class 5 felony pursuant to § 18-7-201.7.

    Solicitation Of A Prostitute – 18-7-202

    If a person solicits another to commit an act of prostitution that person commits a class 3 misdemeanor pursuant to C.R.S. § 18-7-202.

    Colorado Pandering Law – 18-7-203

    Pandering means that a person – for money or other thing of value, induces another to commit prostitution by menacing or intimidating that person, or arranges a situation in which a person may commit prostitution.

    Pandering is a class 5 felony if it involves menacing or intimidating the other person, and a class 3 misdemeanor in other situations.

    Keeping A Place Of Prostitution in Colorado – 18-7-204

    (1) Any person who has or exercises control over the use of any place which offers seclusion or shelter for the practice of prostitution and who performs any one or more of the following commits keeping a place of prostitution if he:

    (a) Knowingly grants or permits the use of such place for the purpose of prostitution; or

    (b) Permits the continued use of such place for the purpose of prostitution after becoming aware of facts or circumstances from which he should reasonably know that the place is being used for purposes of prostitution.

    Keeping a place of prostitution is a class 2 misdemeanor.

    Colorado Pimping Law – 18-7-206

    Any person who knowingly lives on or is supported or maintained in whole or in part by money or other thing of value earned, received, procured, or realized by any other person through prostitution commits pimping, which is a class 3 felony.

    Colorado Public Indecency Law – 18-7-301

    Public indecency consists of performing in public any act of sexual intercourse or lewd exposure or fondling of the body that is done with the intent of arousing the sexual desire of any person. See C.R.S. § 18-7-301.

    Public indecency is a class 1 petty offense.

    Colorado Indecent Exposure Law, C.R.S. § 18-7-302,

    Indecent exposure, C.R.S. § 18-7-302 is committed when a person knowingly exposes his genitals to the view of another person under circumstances in which the exposure is likely to affront or alarm the other person.

    Indecent exposure is a class 3 misdemeanor, unless the person to whom the genitals are exposed is under 15, in which case indecent exposure is a class 3 misdemeanor.

    A second conviction for indecent exposure is a class 1 misdemeanor, and any subsequent convictions become a class 6 felony.

    Note that almost ALL of Colorado’s CITIES and TOWNS also have their versions of anti-prostitution laws. It would be impossible to list them all here. My suggestion is go to the website of the city or town involved and see if their local criminal laws are published online.

    Unfortunately a conviction for prostitution – even though this form of the crime is only a misdemeanor in most instances – can lead to the loss of present or future employment – especially the helping and service professions such as education, nursing, law, accounting and many, many others. People with licenses – such as nurses and teaching need to be especially aware of “moral turpitude” based terms of their employment contracts.. and notification of the department of education of a teacher’s conviction.
