Another False Report Of Rape – Sexual Assault – This One Charged With False Reporting

By H. Michael Steinberg Colorado Sex Crimes Criminal Defense Lawyer – Attorney

False Report Of Rape – Sexual Assault- This One Charged With False Reporting- I recently wrote an article asking why more alleged “victims” who have lied in order to bring charges are not themselves charged with false reporting or even perjury. In Connecticut a District Attorney had no choice – because of the statements of Nikki Yovino – a student at Sacred Heart University who lied about being raped – but to charge her with the crime of false reporting.

The Terrible Impact On The Victims Of False Allegations Of Rape – Domestic Violence

The destruction of the life of a person accused on rape – their reputations ripped to pieces by self-righteous “an-rape” crusaders – cannot adequately be described here. The best description I could find was from a UK article in the Telegraph ‘Guilty until proven innocent’: life after a false rape accusation – in which a school teacher named David said this:

“And now,…I am tarnished, shamed and alienated. And I cannot describe how it feels to have had my country do this to me in such a cold blooded way. My hands still feel tied, and I am humiliated amongst my community – whilst the person who accused me is still walking the streets like a sorry victim, telling people that I have raped others. And this is all down to the system itself.”

Why Does A Woman Make False Allegations Of Sexual Assault?

The personal motivations of the – mostly women accusers – who make false accusers will vary with the woman. The consequences to the victims of false accusations, include the loss of careers, marriages, scholarships, .. entire lives at each and every stage – are destroyed.

In a sworn affidavit used to file charges against Ms. Yovino, she said she made up the allegations of sexual assault because “it was the first thing that came to mind and she didn’t want to lose (another male student) as a friend and potential boyfriend.” She also told the police that she believed when her targeted future boyfriend heard the allegation, “it would make him angry and sympathetic to her.”

Nikki Yovino, at the ripe age of 18, has confessed to the false rape allegations and as a result the two football players were later cut from the team. Two innocent young men who did nothing wrong – who had clearly engaged in consensual sex lost their scholarships and were forced into leaving Sacred Heart.

Finally Justice – The False Accuser Is Charged With The Crime Of False Reporting And Tampering

In Connecticut the crime of second-degree false reporting of an incident is charged under this law:

Sec. 53a-180c. Falsely reporting an incident in the second degree Class A misdemeanor

(a) A person is guilty of falsely reporting an incident in the second degree when, knowing the information reported, conveyed or circulated to be false or baseless, such person gratuitously reports to a law enforcement officer or agency (1) the alleged occurrence of an offense or incident which did not in fact occur, (2) an allegedly impending occurrence of an offense or incident which in fact is not about to occur, or (3) false information relating to an actual offense or incident or to the alleged implication of some person therein.

(b) Falsely reporting an incident in the second degree is a class A misdemeanor

Class A misdemeanors are the most serious misdemeanors in Connecticut, punishable by up to one year in jail and a fine of up to $2,000.

Yovino was also charged with the more serious crime of Tampering With Or Fabricating Physical Evidence – a felony punishable by up to five years in prison.

Good police work – that resulted from questioning other witnesses who were present during the alleged rape resulted in breaking the case wide open. This is almost never the case in the kangaroo courts of sex assault investigations on the nation’s college campuses.

Colorado authorities could learn much from the way this case was investigated and handled.
